William Swain Associate

Will Swain joined Gilbert LLP in 2023. He represents corporate and individual clients in a variety of complex civil litigation matters. Prior to joining Gilbert, Will was a law clerk at a civil and criminal law firm in North Carolina and a public finance, affordable housing, and economic development law firm that served communities across North Carolina.

Will earned his law degree from North Carolina Central University School of Law and received several book awards and scholarships for academic performance. He was Senior Editor of the North Carolina Central Law Review and a Legal Writing Tutor. At NCCU’s Juvenile Law Clinic, Will represented juvenile clients facing criminal complaints with the guidance of a prominent Durham, N.C. judge.

REPRESENTATIVE MATTERS

  • Advising a consumer products manufacturer on issues related to retailer indemnification claims and liability insurance coverage.
  • Representing a bankruptcy trust in Chapter 11 and adversary proceedings to recover insurance proceeds on behalf of various creditor groups.
  • Representing incarcerated individuals in federal court proceedings stemming from claims concerning prison conditions and abuse.
  • Assisted in securing a multi-million-dollar settlement of a decade-long dispute over liability insurance proceeds on behalf of a global background screening company whose liability insurer refused coverage.
