Gilbert LLP served as Special Insurance Counsel to the Official Committee of Talc Claimants (TCC) in the bankruptcy of Presperse Corporation, which in 2025 culminated in the historic confirmation of a bankruptcy plan and the creation of a Section 524(g) Talc Personal Injury Trust. Gilbert’s advocacy secured a favorable settlement with Hartford Casualty Company for the benefit of the Trust, a recovery that was specifically recognized by the Court. Working with co-counsel, Gilbert’s team successfully navigated and resolved objections from The Hartford and the United States Trustee to ensure the plan’s confirmation and protected against unnecessary administrative costs. This precedent-setting victory marked the first time a Section 524(g) trust has been established in a talc bankruptcy.
