Gilbert LLP Secures Landmark Win for Talc Claimants in Presperse Bankruptcy

WASHINGTON, D.C. – Gilbert LLP, a premier law firm specializing in complex dispute resolution, announced today its successful representation of the Official Committee of Talc Claimants (“TCC”) and the Future Talc Personal Injury Claimants (“FCR”) in the bankruptcy proceedings for Presperse Corporation, In re Presperse Corporation, in the United States Bankruptcy Court for the District of New Jersey.

On July 31, 2025, the Bankruptcy Court entered an Order approving the Bankruptcy Plan and establishing the Talc Personal Injury Trust (the “Trust”), which is the first talc-related trust established under Section 524(g) of the Bankruptcy Code, a mechanism specifically intended to address asbestos-related liabilities. The confirmation of the plan, which provides in excess of $50 million for the Trust, was the result of a concerted effort by the TCC, including Gilbert, to resolve objections from Hartford Fire Insurance Company and Hartford Casualty Company (together, “The Hartford”) and the United States Trustee (“UST”).

Gilbert served as special insurance counsel to the TCC, a committee established to represent individuals with personal injury claims arising from their use and exposure to talc produced or supplied by Presperse, and the FCR, which represents the interests of individuals who may assert claims in the future, but whose talc-related diseases have not yet manifested. Gilbert’s work was instrumental in securing an $8 million settlement with The Hartford from insurance policies issued to Presperse. The settlement was reached after hard-fought negotiations and was specifically recognized by the presiding judge for the significant effort involved.

The successful confirmation of the Presperse Bankruptcy Plan marks a landmark moment, as it is the first-ever talc bankruptcy case to be confirmed in a bankruptcy court and to contain a Section 524(g) injunction.
