Nicole Wemhoff Associate

Nicole Wemhoff joined Gilbert LLP in 2026. She represents a wide range of health care providers in reimbursement disputes with commercial health insurance companies. Nicole has been involved in litigation against many of the nation’s largest payors and repricers of health care services, including UnitedHealthcare, Cigna, Anthem, Aetna, and MultiPlan. Prior to joining Gilbert LLP, Nicole was an associate at a mid-size law firm in Washington, DC where her practice included advising clients with regards to pre- and post-payment payor audits and claims disputes and counseling clients on compliance with the No Surprises Act and Price Transparency requirements.

Nicole regularly represents providers in mediation and arbitration involving contract and reimbursement disputes. Her practice is focused on helping health care providers navigate and resolve high‑stakes disputes with payors efficiently and effectively.

REPRESENTATIVE MATTERS

  • Representing direct action plaintiffs in a federal multidistrict antitrust litigation involving an alleged conspiracy to systematically suppress out-of-network reimbursement rates using algorithmic pricing and coordinated data exchange amongst major health insurance companies.
  • Representing a behavioral health care provider against multi-million dollar overpayment dispute alleging fee forgiveness and medical record documentation deficiencies.
  • Representing patients in putative ERISA class action against a commercial insurance company and a third party repricing company regarding underpayment of benefits for intensive outpatient substance use disorder treatment.
  • Representing nationally prominent hospital staffing company in compliance with No Surprises Act independent dispute resolution process.
  • Representing health care providers in ERISA litigation over coverage and payment of benefits.
  • Counseling substance use disorder treatment providers on compliance with federal and state confidentiality requirements.
