Gilbert LLP partner Mark Packman was published last week in the Fall edition of the Tort Trial & Insurance Practice Law Journal with an article examining the Constitution’s Contracts Clause and proposed state legislation aimed at protecting business interruption claims for businesses suffering from COVID-19 losses.
The article, entitled “Constitutionality Under the Contracts Clause of Proposed Legislation Enabling Policyholders to Obtain Insurance Coverage for Coronavirus Claims,” explores the flaws of the insurance industry’s argument that various state proposals violate the Contracts Clause.
